Contrary to the General Counsel's contention, the majority noted that they did not conclude that the precertification comments of Vice Presidents Rutherford and Ferguson were irrelevant to the surface bargaining issue and instead found that the comments were insufficient to show that the General Counsel had proven the allegation by a preponderance of the evidence.
